Court of Appeal grants application by business man Alfred Agbesi Woyome setting aside all findings made against him by the Judgement Debt Commission

The Court of Appeal has granted an application by business man, Alfred Agbesi Woyome seeking the Court to set aside all findings made against him by the judgement debt commission chaired by Sole Commissioner, Justice Yaw Appau.

 The three member panel presided over by Justice Victor Ofoi in its ruling said the sole commissioner failed to give the applicant fair hearing which is a breach of natural Justice.

 It said it was unconstitutional not to have invited Woyome before it made adverse findings against him. It was the case of the commission that it did not invite Woyome because the matter was at the Supreme Court and inviting Woyome would be sub judicial and therefore relied on copious documents from Woyome and EOCO. 

The Supreme Court last year also ruled similarly by a unanimous decision that the findings of the Justice Yaw Appau Commission relating to the Alfred Agbesie Woyome and the Attorney General as well as the Sky Consult Vrs Ghana Post cases were unconstitutional.

 The court held that the Justice Apau Commission’s report was in breach of Articles 125 (1) (3) 127 (1) of the constitution and amounted to judicial interference and a violation of the independence of the judiciary. Justice Yaw Appau, the sole Commission was inaugurated on October 8, 2012. 

The Commissioner submitted its findings to the government in May 20, 2015 and pointed to some breaches in procedure and law by government and public officials which led to causing financial loss to the State.
