Supreme Court dismisses suit challenging legal capacity of Tiger Eye PI

The Supreme Court has dismissed the suit challenging the legal capacity of Tiger Eye PI to petition the President for the removal of twelve High Court Justices caught in the judicial corruption scandal.

The suit was filed by Justice Uuter Dery, Justice Ayisi Addo and Justice Habib Logoh. 

The three implicated High Court justices were invoking the original jurisdiction of the court to declare that the petition by Tiger Eye PI to remove them from office was inconsistent with the Constitution because the company lacked legal capacity to do so.

But the Court held that Anas Aremeyaw Anas conducted the investigation in his capacity as a citizen of the country and also as a journalist and a lawyer.

The five member panel of judges also said that the applicants were concerned with the petition to the President which was on the letterhead of Tiger Eye PI.

The judges said the applicant’s contention was with the form of the letter and not it’s content. 

This, the Court believes is irrelevant.
 
The plaintiffs wanted a declaration that the President’s referral of the petition to the Chief Justice to establish a prima facie case against them is in contravention of Article 146 sub section three of the constitution. 

The three implicated Superior Court judges also wanted a perpetual injunction against any investigative or adjudicative body from determining any issues arising out of the petition and a restraining order to prevent the Chief Justice from proceeding further with the impeachment process.
