Supreme Court dismisses suit against Woyome 

The Supreme Court has dismissed a suit which sought to challenge the Court’s order for a refund of over 52 million cedi judgement debt paid to businessman, Alfred Agbesi Woyome. 

The Court also awarded a GHc15, 000 cost against the plaintiff Alhaji Abdulai Yusif Mohammed. The Court did not give any reasons for its decision but said it will file them on the 3rd of next month.  

According to the plaintiff, the Supreme Court lacked jurisdiction to hear the case and therefore sued the Attorney General, a former Attorney General, Martin Amidu and Mr Woyome.

The nine member panel chaired by the Chief Justice, Georgina Theodora Wood, also ordered that the cost should be paid personally by the counsel for the plaintiff Kwasi Afrifa to the defendants. The AG was awarded 5,000 cedis whiles Mr Amidu was awarded 10 thousand cedis. 

Lawyer for Mr Woyome, Ken Awuku however declined to press for cost. The court said it is departing from its previous stand of not awarding cost to deter others from embarking on such frivolous actions on constitutional matters. 

The plaintiff withdrew the suit after several arguments which the court found unmeritorious and misleading. 

Mr Amidu however argued that the plaintiff should not be allowed to escape through the side door as it could open the flood gates for similar frivolous actions in future and prayed the court to dismiss the suit. 

A counter claim also filed by Mr Woyome’s lawyer, Ken Awuku was also dismissed by the court. 

Mr Amidu described the claim as incompetent and not in consonance with the constitution.
